Affiliate Program Terms

These Affiliate Program Terms (the “Terms”) govern participation in the Gifted Hands CT Affiliate Program (the “Program”), operated by Gifted Hand Services LLC d/b/a Gifted Hands CT (“Gifted Hands CT,” “we,” “us,” or “our”). By applying to or participating in the Program, you (“Affiliate,” “you”) agree to these Terms.

Affiliate Program Enrollment and Approval Process

• Apply through our affiliate portal at affiliates.giftedhandsct.com, which is powered by Partnero, our affiliate tracking platform.
• You must be at least 18 years old and able to receive payments via an accepted payout method.
• We may approve or decline any application at our sole discretion, and we may re-review accounts at any time. We are not required to give a reason for declining an application.
• Providing false information during enrollment is grounds for immediate termination.
• Personal information you provide as an Affiliate (including payout details) is processed by Partnero on our behalf and handled as described in our Privacy Policy at giftedhandsct.com/privacy-policy/.

How Affiliate Referrals and Sales Are Tracked

• Referral links: Each Affiliate receives unique referral links through Partnero. Referrals are tracked with a 30-day cookie: if a customer clicks your link and completes a qualifying purchase, signup, or booking within 30 days, the referral is credited to you (subject to the qualification rules below).
• Coupon codes: We may also assign you a personal coupon code. Qualifying orders that use your assigned code are credited to you even without a cookie.
• If more than one Affiliate could claim the same referral, credit is determined by Partnero’s attribution logic (generally last click, or the coupon code used). Our attribution records are final.

Qualification rules:

• Shop sales: Commission is calculated on the product subtotal, excluding taxes, shipping, and discounts. Orders that are refunded, cancelled, or charged back do not qualify (or are clawed back if already credited).
• Membership signups: The referred person must be a new Gifted Circle member who completes signup and first billing. Signups that cancel or reverse payment before the first billing completes do not qualify.
• Service bookings: The $20.00 reward is paid only when a first-time client you referred completes their appointment (not merely books or pays a deposit). No-shows, cancellations, and deposit-only bookings that never complete do not qualify.
• Never qualifying: (a) your own purchases, memberships, or bookings (self-referrals); (b) purchases or bookings by members of your household or accounts you control; (c) $0 redemptions by giveaway winners (a free service redeemed by a winner of the Gifted Hands CT Monthly Brow Giveaway generates no commission); (d) fraudulent, abusive, or manipulated transactions.

Affiliate Payout Schedule and Payment Methods

• Payouts are made via PayPal or Wise to the account you register in the affiliate portal.
• Minimum payout: $25.00. Balances below the minimum roll over to the next payout period.
• Payout schedule: monthly, with a 30-day holding period after a commission is earned, so refunds and chargebacks can be reconciled before payment. Commissions reversed during the holding period are deducted from your balance.
• You are responsible for any fees charged by your payout provider and for providing accurate payout details. We may request a completed tax form (e.g., IRS Form W-9) before releasing payouts where required.

Affiliate Compliance Requirements and Legal Obligations

Violation of this Section 5 may result in immediate termination from the Program and forfeiture of all unpaid commissions.

FTC Disclosure Requirements For Affiliates

You have a material connection to Gifted Hands CT: you earn money from referrals. Under the FTC’s Endorsement Guides, you must clearly and conspicuously disclose that connection everywhere you promote us, including social media posts, stories, videos, blogs, emails, and messages. Acceptable disclosures include:

• #ad or #sponsored placed where viewers will see it (not buried in a wall of hashtags)
• “I earn a commission from referrals to Gifted Hands CT”
• “Affiliate link” stated plainly next to the link

The disclosure must be visible before or alongside the promotion, in the same language as the promotion, and hard to miss.

Giveaway And Sweepstakes Rules For Affiliates

Gifted Hands CT runs the “Gifted Hands CT Monthly Brow Giveaway” under separate Official Rules, available at giftedhandsct.com/giveaway-rules/. When mentioning the giveaway, you must not:

• Describe the giveaway using gambling or lottery terminology of any kind in any promotion, post, caption, or message. It is a giveaway or sweepstakes, and you must refer to it only as a giveaway or sweepstakes.
• State or imply that purchasing products, booking services, or joining The Gifted Circle improves anyone’s odds of winning. No purchase is necessary, a free entry method is available, and all entries have equal odds.
• Misstate, embellish, or contradict the giveaway’s Official Rules in any way.

Any violation of this Section 5.2 results in immediate termination and forfeiture of unpaid commissions.

Truthful Advertising Standards For Affiliates

• No income, earnings, or results guarantees about the Program (“make easy money,” fabricated earnings screenshots, etc.).
• No guaranteed cosmetic results claims about services, and no health, medical, or drug claims about skincare products. Our products are cosmetics.
• No false scarcity, fake discounts, or invented endorsements.

Prohibited Promotion Methods In This Program

You must not:

• Send spam (unsolicited bulk email, SMS, or DMs) or violate CAN-SPAM, TCPA, or platform rules.
• Bid on our brand terms in paid search or paid social ads, including “Gifted Hands CT,” “Gifted Hand Services,” misspellings, or variations, and you must not use our brand terms in ad display URLs or impersonate our official accounts.
• Self-refer, refer household members, or use your own coupon code for your own or coordinated purchases.
• Abuse coupon codes, including posting assigned codes to coupon-aggregator sites in a way we prohibit, stacking, or misrepresenting a code’s terms.
• Use cookie stuffing, forced clicks, iframes, typosquatted domains, bots, or any technical manipulation of tracking.
• Promote us on sites or content involving illegal activity, hate, or adult content, or target children (our services are 18+).

Limited Use of Gifted Hands CT Trademarks and Assets

While you are an active Affiliate in good standing, we grant you a limited, revocable, non-exclusive, non-transferable license to use the Gifted Hands CT name, logo, and marketing materials that we provide through the affiliate portal, solely to promote the Program as permitted by these Terms. You may not modify our marks, create your own Gifted Hands CT branded assets, register domains or social handles containing our marks, or suggest you are Gifted Hands CT or an employee of ours. This license ends automatically when your participation ends.

Independent Contractor Status of All Affiliates

You are an independent contractor. Nothing in these Terms creates an employment, agency, partnership, joint venture, or franchise relationship. You have no authority to make commitments on our behalf, and you are solely responsible for your own taxes, expenses, and compliance with laws that apply to your promotional activities.

Affiliate Program Termination Rights and Grounds

• By you: You may leave the Program at any time by notifying us or closing your portal account. Qualifying commissions earned before departure and surviving the holding period will be paid at the next scheduled payout.
• By us: We may suspend or terminate your participation at any time, with or without cause, on notice to your registered email. If termination is for a violation of Section 5, all unpaid commissions are forfeited. If termination is without cause, earned commissions that survive the holding period will be paid.
• We may also pause or discontinue the entire Program at any time.

Changes and Updates to Affiliate Program Terms

We may update these Terms from time to time. We will post the updated Terms in the affiliate portal and notify active Affiliates by email at least 14 days before material changes take effect. Continued participation after the effective date constitutes acceptance. If you do not agree to a change, your remedy is to leave the Program before it takes effect.

Disclaimers, Indemnification, And Liability Limitations

The Program is provided “as is.” We do not guarantee any level of traffic, conversions, or earnings. To the fullest extent permitted by law, our total liability to you arising out of the Program is limited to the unpaid commissions properly owed to you at the time the claim arises.

You agree to indemnify and hold harmless Gifted Hands CT and its owner from any claims, damages, penalties, and expenses (including reasonable attorneys’ fees) arising out of your promotional activities, your breach of these Terms (including the disclosure requirements in Section 5.1), or your violation of any law or platform rule.

Governing Law for Gifted Hands CT Affiliate Terms

These Terms are governed by the laws of the State of Connecticut, without regard to conflict-of-law rules. Any dispute arising from the Program shall be brought in the state or federal courts located in Connecticut, and you consent to their jurisdiction.
